Donor Drive - a donor drive is a good hard drive with the same model and firmware as your defective drive, from which we will extract the parts in order to make your hard drive functional for data recovery purposes. This is needed especially if there is a hardware problem on your drive. Destination Drive - is a EMPTY and GOOD drive into which we will transfer the recovered files. Customers are required to provide their own destination drives.DATA RECOVERY SERVICE AGREEMENT The scope of this agreement's Terms & Conditions covers the data recovery work order for [Company or Person Owning the Medium], delivered by Truservice Computer Repair Services. The SERVICE PROVIDER hereby EVALUATION - We commit to conducting a thorough evaluation using all resources and technology available at our Data Recovery Head Office, laboratory, and clean room. However, no warranty is offered, either stated or implied, regarding the absolute accuracy of this evaluation." COST ESTIMATE - A quote for the cost of recovery, payable in Philippine Pesos (PHP) and excluding any diagnostic fees, will be provided to the client before recovery work begins. SHIPPING AND INSURANCE - Damage to the client's property that occurs during shipment from their location, or for shipments that are not insured, is not the responsibility of the Service Provider. MISINFORMATION - Asserts to fully charge, if through its recovery efforts it is revealed that it has not been told the truth costing it extreme effort & expense. - Charges the CLIENT for additional recovery work on the client's medium arising from the misinformation. TURNAROUND TIME - Diagnoses medium for within 3-5 working days for regular process, and 1-2 working days for rush service. - Attempts to recover data at Normal Recovery Process (10-15 working days) and Rush Recovery Process (3-5 working days). OWNERSHIP - Receives in good faith that storage medium is submitted by the legal owner or an authorized representative. FAILURE TO CLAIM PROPERTY - Disposes the storage medium if unclaimed beyond 30 days, without liability to the client or any third party. CONFIDENTIALITY AND NON-DISCLOSURE - Agrees not to disclose information or data supplied with, stored on, or recovered from client equipment except to concerned staff, contractors, and attorneys subject to confidentiality agreements. PREPAYMENT AND FINAL PAYMENT - Ensures payment to be required from CLIENT is consistent with what is stated in the approved quotation. - Issues a receipt for payment covering all taxes, (unless with tax-exempt proof) including, but not limited to sales and services. The CLIENT hereby EVALUATION - Submits the medium with stored data requiring recovery to the SERVICE PROVIDER. COST ESTIMATE - Has the option to accept or reject the recovery service quotation. - Pays 50% downpayment, once approving the quote, to proceed. TRANSPORTING THE MEDIUM - Authorizes SERVICE PROVIDER to transport the medium between facilities. SHIPPING AND INSURANCE - Notifies courier of special packaging needed to ensure safe delivery, and of the value of the medium, if insurance is required. MISINFORMATION - Is liable for recovery expenses arising from misinformation, including, but not limited to cases related to RAID array or server, or state of the array, i.e., rebuild was done, failed disk is taken back online, disk in RAID set fails. TURNAROUND TIME - Allows SERVICE PROVIDER to perform diagnosis and data recovery work within stated turnaround time, and beyond the same, in necessary. OWNERSHIP - Affirms ownership of the storage medium and data. Indemnifies SERVICE PROVIDER for claims by a 3rd party related to this recovery. FAILURE TO CLAIM PROPERTY - Acknowledges that it cannot hold the SERVICE PROVIDER liable for the disposal of his storage medium, if unclaimed within the 30-day term. CONFIDENTIALITY AND NON-DISCLOSURE - Agrees not to disclose, under any circumstance, to any third party, including but not limited to any person, company, website, blog, public forum or other news agency, the terms of this Agreement. PREPAYMENT AND FINAL PAYMENT - Agrees to pay 50% of quote as downpayment, to allow the initialization of recovery process. - Agrees to pay in full prior to data transfer to destination drive. In case of a refund, agrees to submit original acknowledgement receipt." ENTIRE AGREEMENT AND ENFORCEMENT - This Agreement (and Addenda) constitutes the entire agreement as to its subject matter superseding all prior & contemporaneous oral and written agreements. - All changes to this Agreement must be made in writing, signed by both parties accordingly, otherwise shall be of no effect. Any action by either party to enforce this agreement shall be brought about only in the courts of the Philippines. - Should any clause, provision, or sentence of this agreement be determined by a court to be invalid, that clause, provision, or sentence alone shall be invalid, & remaining parts of this agreement shall be considered in full force and in effect. - In any action to enforce this Agreement, the prevailing party shall be entitled to recover its costs and expenses, including reasonable charges. - Mutual agreement of the 2 parties, to the stipulated mutual promises contained herein which constitute full and adequate consideration for provisions of this Service Agreement. - Stipulation & agreement of both to entry of an Ex Parte Temporary Restraining Order to prevent any threatened, anticipated, or actual breaches of this section by either party. * Truservice Computer Repair Services, warrants and commits that “any claims of missing, corrupted, or otherwise damaged data made in writing within 5 business days of receipt” of the recovered data will be reserviced without any additional cost to the client.Consent *Yes, I agree with the DATA RECOVERY SERVICE AGREEMENT, TERMS & CONDITIONS, and PRIVACY POLICY described or written in this form.
